Disclosure Notice of Creditable Coverage

Employers Must File Creditable Coverage Disclosure Notices by March 31, 2006


Certain employers that sponsor a group health plan must complete a Disclosure Notice and file it with the Centers for Medicare and Medicaid Services (CMS) by March 31, 2006.  Priority Health cannot file this notice for employers.  Priority Health sent all employers and agents a notice to this effect in February 2006.

How to File a Disclosure Notice


1. Go to the CMS website and look for "Related Links Inside CMS." Note: While there, you may also want to look at the "Disclosure to CMS Guidance" PDF document listed under Guidance Documents.

2. Click on "Disclosure to CMS Form" to open the online Creditable Coverage Disclosure form.

3. Complete the online form. You'll need to know:
  • Your Federal ID number
  • Whether your plans are creditable or non-creditable. All Priority Health plans offer creditable prescription coverage, except: All HealthSavingsSM (HSA) plans, 50% Rx without contraceptives (sole-proprietor Rx benefit), and select self-funded employer group plans (these groups have been notified individually).
  • Dates of your plan year (beginning and ending)
  • Number of Part D-eligible individuals, and how many you expect will be covered under the plan
  • Date that Priority Health mailed the annual Creditable Coverage Disclosure to eligible individuals: November 14, 2005
4. Click "Submit."


Employers must file this disclosure annually, or whenever they make a change that affects whether or not the drug coverage they offer is creditable.
